The Orissa High Court has ordered the immediate reinstatement of judicial officer Ipsita Mohanty, whose 2022 resignation was accepted by the Odisha government.
Mohanty resigned after being transferred to Hindol in Dhenkanal district, where specialised treatment for her 15-year-old autistic son was unavailable, despite her requests for a posting in Bhubaneswar.
Mohanty withdrew her resignation less than a month after submitting it, but the High Court Registry failed to communicate the withdrawal before the Governor approved the resignation.
The court held that the resignation was not voluntary but made under duress, and declared the relieving notification of January 2, 2023 bad in law.
Mohanty will be reinstated with continuity of service from January 3, 2023, but without back wages for the period she remained out of service, because she undertook to forgo those financial claims.
