The Karnataka High Court has ordered the CID to take over and reinvestigate a case in which a woman from Delhi was assaulted by a colleague in Bangalore after an office party, in an attack the court said involved an attempt to rape her.
A single-judge bench of Justice M. Nagaprasanna criticised the prosecution for charging the accused only with attempt to murder, despite the victim's statement describing sexual violence, and noted lapses such as the accused's clothes going missing, the knife not being sent to the forensic lab, and blood stains in the car not collected.
The court held that the right to a fair investigation is part of Article 21 of the Constitution.
The case must be handed to the CID within 15 days, and the CID must complete its investigation and report to the court within three months, with trial court proceedings stayed until then.
